1. Acceptance of Terms

By accessing or using SafaraBlue (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and SafaraBlue.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years old, you may only use the Service with the consent of a parent or legal guardian.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4. User Content

The Service allows you to post, share, and otherwise make available content, including text, images, mood entries, and other materials ("User Content"). You retain ownership of your User Content. By posting User Content, you grant SafaraBlue a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving the Service.

You agree not to post User Content that:

• Is unlawful, harmful, threatening, abusive, or harassing
• Infringes any intellectual property or privacy rights
• Contains spam, malware, or deceptive content
• Promotes violence, discrimination, or illegal activities
• Impersonates any person or entity

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, crawl, or use automated means to access the Service without permission
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service to send unsolicited communications
• Create multiple accounts to evade bans or restrictions

6. Subscriptions and Payments

Certain features of the Service are available on a subscription basis. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. All payments are processed securely by Stripe. We do not store your payment card details.

Refunds are available within 14 days of initial purchase for annual subscriptions. Monthly subscriptions are non-refundable. To request a refund, contact [email protected].

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of SafaraBlue and its licensors. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SAFARABLUE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

SafaraBlue is a wellness social platform and is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFARABLUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

10. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. You may terminate your account at any time by contacting us.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SafaraBlue operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date and, where appropriate, notifying you via email or in-app notification. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
